Civil Procedure Research Guide

Overview

Like the Federal Courts, each state has its own rules of civil procedure and statutes that govern how litigation is conducted. The states also have local rules for each level of court. The following will provide you with links to state resources from Lexis+ and Westlaw as well as open access resources that provide information on the civil procedures rules and laws for each state. 

Legal Research Databases

Lexis provides access to the rules of civil procedure and relevant statutes for each state. Select the State tab under the Search Bar and then select the specific state you would like to view. The rules and statutes can be found under the Statutes & Legislation dropdown menu.

To access civil procedure rules and statutes in Westlaw, select the State Materials tab under the Search Bar then select the specific state you would like to view. The Statutes and Court Rules section will have the relevant procedural rules and laws for the state.

Open Access Resources

The Legal Information Institute provides links to state codes of civil procedure. 

The National Center for State Courts provides links to each state's court websites which you can then search for rules of court. The state tabs provide a list of links to court website for that specific state. Most websites will have a tab related to rules and procedures on their main page. You can also use the website's search bar if necessary. 

The Library of Congress Guide to Law Online also provides links to free online legal resources for each state including information on constitutions, executive, legislative, and judicial branches, legal guides, and general sources.
